Overview

Managers have hard jobs. They have to be knowledgeable about your business, but they are also the “front line” that often has the first chance to defuse – or create – potential employment-related liabilities. An uninformed manager can create risks everywhere in their wake. Asking about medical issues during job interviews? Inflating performance reviews to keep things positive? Brushing off complaints about the “touchy” co-worker? Firing an employee for attendance issues? These are just a few of the ways in which a manager can create risk and liability for the employer, sometimes before the employer ever even knows about it. In this program, we’ll cover the common scenarios in which managers trigger employment liability and talk about the proactive steps that should be taken to prevent your manager from becoming your worst nightmare.

  1. Learning when employers are held liable for managers’ mistakes.
  2. Identifying the most common areas in which managers’ mistakes create employment liability.
  3. Identifying the proactive steps that employers can and should take to prevent inadvertent liability.

Speaker

Joseph C. Chancey – Partner, Drew Eckl & Farnham

Joe Chancey has been practicing for more than 25 years and focuses in the areas of commercial and employment law. He has successfully represented clients in a range of commercial suits, including claims for breach of contract, commercial torts, unfair competition, theft of trade secrets and breaches of fiduciary duty. In addition, Chancey has effectively defended cases that run the gamut of employment laws, including discrimination and harassment claims, wage and hour claims, and claims under the Americans with Disabilities Act, Family and Medical Leave Act and Age Discrimination in Employment Act. He also has substantial experience in cases involving non-compete and non-solicitation agreements. Chancey has defended clients before all of the governmental regulatory agencies in the employment law arena, including hundreds of EEOC charges, as well as charges and investigations before the National Labor Relations Board (NLRB), the US Department of Labor and the Georgia Department of Labor.
